These Terms of Service (“Terms”) govern your use of the Smart Printer mobile application (the “App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1) License and ownership

The App is licensed, not sold. Subject to these Terms and applicable law, you are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use on Apple-branded devices you own or control, as permitted by the App Store rules.

All intellectual property rights in the App (including trademarks, copyrights, and other rights) are owned by the Service Provider. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, disassemble, translate, or create derivative works of the App except to the extent allowed by law.

2) Acceptable use

You agree not to:

  • violate any applicable law or regulation;
  • interfere with the App’s security, availability, or normal operation;
  • use the App to infringe the rights of others.

You are responsible for the content you choose to print or scan and for ensuring you have the necessary rights to use it.

3) Device integrity (jailbreak/root)

You are responsible for maintaining the security of your device. The App may not function correctly on devices that are jailbroken, rooted, or otherwise modified to remove operating system restrictions. The Service Provider is not responsible for issues arising from such modifications.

4) Internet connectivity and carrier charges

Some App features may require an internet connection (for example, to verify subscription status). The Service Provider is not responsible for reduced functionality due to lack of connectivity. You are responsible for any mobile carrier or third-party charges (including roaming charges) incurred while using the App.

5) Subscriptions and billing (Apple In-App Purchase)

5.1 Subscription options

The App offers auto-renewing subscriptions, including:

  • Weekly subscription
  • Yearly subscription

Pricing and terms are shown at the time of purchase.

5.2 Payment processing

Payments are processed by Apple via In-App Purchase. The Service Provider does not collect or store your payment information.

5.3 Auto-renewal

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your Apple account will be charged for renewal within 24 hours prior to the end of the current period.

5.4 Managing/canceling

You can manage or cancel your subscription in iOS Settings under Subscriptions. Deleting the App does not cancel your subscription.

5.5 Trials and promotions

If a free trial or promotional offer is available, it will be disclosed at purchase. Unless you cancel before the trial ends, the subscription may convert to a paid subscription and renew automatically.

5.6 Refunds

If you have questions about charges, billing issues, or believe you are eligible for a refund, you can contact us at support@tickedapps.com and we will do our best to help you understand the charge and provide guidance.

Please note that subscriptions and In-App Purchase payments are processed by Apple. As a result, refunds are subject to Apple’s policies and generally must be requested through Apple’s official support/refund process. The Service Provider cannot guarantee that Apple will approve a refund request.

5.7 RevenueCat

The Service Provider uses RevenueCat, a third-party subscription management service, to manage subscription status, entitlements, and access to premium features within the App.

RevenueCat does not process payments. All payments, renewals, and refunds are handled by Apple through the App Store.

Access to subscription features may depend on successful communication with Apple’s and RevenueCat’s services. Temporary interruptions or delays in entitlement verification may occur and do not constitute a breach of these Terms.

6) Availability, updates, and compatibility

The Service Provider may modify, update, suspend, or discontinue the App (or any part of it) at any time. Updates may be required to continue using the App. The Service Provider does not guarantee ongoing compatibility with all devices, printers, networks, or operating system versions.

Certain features of the App may only be available while an active subscription is successfully verified. The Service Provider does not guarantee uninterrupted access to subscription features in cases where verification cannot be completed due to network issues, third-party service outages (including Apple or RevenueCat), or device configuration issues.

You are responsible for keeping your device charged and operational. The Service Provider is not responsible for interruptions caused by your device (including a depleted battery).

7) Disclaimer

The App is provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, the Service Provider disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Printing/scanning performance may depend on third-party hardware, network conditions, and device settings.

8) Limitation of liability

To the maximum extent permitted by law, the Service Provider will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill.

To the extent permitted by law, the Service Provider’s total liability for any claim relating to the App will not exceed the amounts paid by you for the App’s subscriptions in the 12 months prior to the event giving rise to the claim.

Nothing in these Terms limits rights that cannot be waived under applicable consumer laws.

9) Termination

You may stop using the App at any time by uninstalling it. The Service Provider may suspend or terminate access if you materially violate these Terms or if required by law. Sections that by their nature should survive (including disclaimers and limitation of liability) will survive.

10) Privacy

Your use of the App is subject to the Service Provider’s Privacy Policy, available on https://www.tickedapps.com.

11) Apple acknowledgements (required)

These Terms are between you and the Service Provider, not Apple. Apple has no obligation to provide maintenance or support for the App.

To the extent permitted by law:

  • Apple is not responsible for claims relating to the App or your use of it.
  • If the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); Apple has no other warranty obligation.
  • Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12) Governing law and jurisdiction

These Terms are governed by the laws of France, without regard to conflict-of-law principles. If you are a consumer residing outside France, you may also benefit from mandatory consumer protection laws of your country of residence.

To the extent permitted by law, disputes will be submitted to the competent courts in France, unless mandatory consumer laws require otherwise.
