Terms of Service — Essence Moins Chère

These Terms of Service (hereinafter the "Terms") govern the use of the Essence Moins Chère mobile application (hereinafter "the App"), published by TickedApps (hereinafter "the Publisher").

By downloading, installing, or using the App, you accept these Terms in full. If you do not accept them, do not use the App.

1. Publisher

2. Service Description

The App allows users to:

• view fuel stations nearby on a map;
• check fuel prices by type (gasoline, diesel, LPG, etc.);
• compare prices and sort stations by price or distance;
• save stations as favorites;
• get directions to a station via Apple Maps or Google Maps.

The core features of the App are free to use. The App may display advertisements and may offer optional auto-renewable subscriptions that unlock additional features, as described in Sections 3 and 4 below.

3. Subscriptions and In-App Purchases

The App may offer optional auto-renewable subscriptions ("Premium" or similar) that unlock additional features. Subscriptions are managed through Apple's App Store and processed by RevenueCat, our subscription management provider.

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to at purchase.
• You can manage or cancel your subscription at any time in your Apple ID account settings (Settings → [your name] → Subscriptions), after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
• Prices are displayed in the App and confirmed by Apple before purchase; they may vary by region and are subject to change with notice.
• No refunds are issued by the Publisher for unused subscription periods; refund requests are handled by Apple in accordance with its own policies.

This App uses Apple's standard End User License Agreement (EULA), available at: apple.com/legal/internet-services/itunes/dev/stdeula.

4. Advertising

The App may display advertisements provided by Google AdMob to support the free features of the App. By using the App, you acknowledge that ads may appear within the interface (banner, native, interstitial, or app-open formats).

Depending on your consent choices (App Tracking Transparency and Google's consent form), ads may be personalized or non-personalized. Advertising is handled in accordance with our Privacy Policy.

The Publisher is not responsible for the content of third-party advertisements displayed within the App, nor for the products, services, or websites they may promote.

5. Origin and Reliability of Prices

Fuel prices displayed come from the open data portal of the French Ministry of Economy (data.economie.gouv.fr), via the dataset "Prix des carburants en France — flux instantané v2."

This data is provided by station operators and updated at their initiative. Therefore:

• displayed prices are provided for indicative purposes only;
• the Publisher does not guarantee the accuracy, freshness, or completeness of the information;
• a price may be outdated, incorrect, or unavailable;
• no claim may be made against the Publisher in case of a difference between the displayed price and the price charged at the station.

The user is solely responsible for verifying the price at the time of fueling.

6. Access Conditions

Use of the App requires:

• a device compatible with iOS 17.0 or later;
• an active Internet connection;
• authorization to access location to display nearby stations (this authorization may be denied, but the experience will be degraded).

Use of the App is reserved for persons aged 15 years or older.

7. User Account

The App does not require account creation. No personal identifier is required to use it. If you subscribe to a premium feature, your subscription is linked to your Apple ID and an anonymous RevenueCat identifier, as described in our Privacy Policy.

8. Intellectual Property

8.1 Publisher's Property

All elements of the App (source code, interface, design, logos, texts, icons, except for the elements mentioned below) are the exclusive property of TickedApps and are protected by applicable intellectual property laws.

Any reproduction, representation, modification, or exploitation of all or part of the App without prior written authorization is prohibited and may constitute an act of counterfeiting punishable under articles L.335-2 et seq. of the French Intellectual Property Code.

8.2 Third-Party Trademarks and Logos

The trademarks, logos, and trade names of fuel station brands (Total, Esso, BP, Shell, Carrefour, Leclerc, etc.) belong to their respective owners. They are used solely for visual identification purposes and imply no affiliation, partnership, or endorsement on their part.

8.3 Public Data

Price data is sourced from the French public data service and made available under the Open Licence v2.0.

9. User Commitments

By using the App, you agree to:

• not use the App for unlawful purposes or in violation of public morals;
• not attempt to circumvent, disable, or disrupt the security mechanisms of the App or API;
• not use automated means (bots, scripts) to query the API;
• not attempt to circumvent, disable, or fraudulently obtain access to premium features without a valid subscription;
• not extract, copy, or redistribute data retrieved via the App for commercial purposes without prior written authorization from the Publisher.

The Publisher reserves the right to block API access to any user who fails to comply with these conditions.

10. Service Availability

The Publisher strives to ensure continuous availability of the App but does not guarantee uninterrupted operation. The service may be temporarily unavailable due to maintenance, updates, or technical failures of the API or hosting provider.

The Publisher cannot be held responsible for the consequences of any unavailability.

11. Liability

To the fullest extent permitted by law:

• the App is provided "as is" and "as available," without warranty of any kind;
• the Publisher cannot be held responsible for direct or indirect damages resulting from the use or inability to use the App, in particular for any additional cost related to an incorrect or outdated fuel price;
• the Publisher cannot be held responsible for the content, availability, or access conditions of third-party sites to which the App redirects (Apple Maps, Google Maps, data.gouv.fr, etc.), nor for third-party advertisements displayed within the App.

The user is solely responsible for the use they make of the information provided by the App.

12. Personal Data

The processing of your personal data is described in our Privacy Policy, which forms an integral part of these Terms.

13. Modification of Terms

The Publisher reserves the right to modify these Terms at any time. Changes take effect upon publication. By continuing to use the App after an update, you accept the new conditions.

14. Termination

You may stop using the App at any time by uninstalling it from your device. Uninstalling removes all locally stored data (favorites, preferences, cache) but does not automatically cancel an active subscription — subscriptions must be canceled separately via your Apple ID account settings.

The Publisher may suspend or discontinue the App at any time, without notice or compensation.

15. App Stores

The App is distributed through Apple's App Store. Apple's App Store terms of use apply in addition to these Terms.

16. Governing Law and Jurisdiction

These Terms are governed by French law.

In the event of a dispute, and after attempting amicable resolution, the competent courts shall be those of the defendant's domicile or the place of service performance, in accordance with general legal rules.

Pursuant to article L.612-1 of the French Consumer Code, consumers may freely resort to a consumer mediator for the amicable resolution of a dispute.
